These Terms and Conditions (“Terms”) govern your access to and use of alivebyalgaari.com (referred to as “we”, “our”, “us”, “Platform”). By accessing or using the Platform, placing orders, subscribing to newsletters, using coupons, or engaging with third-party services integrated on our Platform, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, you must not use the Platform.
1. Definitions #
In these Terms, the following terms shall have the meanings assigned to them:

2. Eligibility #
You must be at least 18 years old and competent to enter a legally binding contract under applicable laws to use this Platform. By accessing the Platform, you represent and warrant that you meet these eligibility criteria.
3. Account Registration #
To place an order, subscribe to newsletters, or use certain services, you may be required to register and create an account with accurate and complete information. You agree to:
- Provide truthful and up-to-date information
- Maintain the confidentiality of your account credentials
- Be responsible for all activities under your account
- Not engage in illegal, unethical activities using your account
We reserve the right to suspend or terminate accounts in case of breach of these Terms.
4. Product Listings and Orders #

Products displayed on the Platform are listed by us or by Sellers. We endeavor to ensure accuracy of product descriptions, prices, images, and availability. However, slight variations may occur.
4.2 Order Acceptance
Order placement does not constitute acceptance. Order acceptance occurs when payment is confirmed and a dispatch or confirmation notification is sent to you.
4.3 Pricing and Taxes
All prices are inclusive of applicable taxes unless otherwise stated. You are responsible for any additional charges levied by banks or payment providers.
5. Payment and Security #
Payments may be processed through integrated third-party payment gateways. We do not store your full payment credentials. By using third-party payment services, you agree to their terms and privacy policies.
You are responsible for ensuring that all payment and billing information provided is accurate.
6. Delivery and Shipping #
Delivery timelines are estimates and commence after order dispatch. We or our logistics partners will make reasonable efforts to deliver within the estimated delivery period. Delivery exceptions due to force majeure, carrier issues, or unforeseen events do not constitute breach.
7. Returns, Refunds, and Cancellations #

8. Seller Terms #
If you register as a Seller on our Platform, the following additional terms apply:
8.1 Seller Obligations (For Products Fulfilled by Creators)
- Provide accurate, lawful, and complete product information
- Ensure compliance with applicable laws and regulations
- Fulfill orders in a timely manner
- Handle returns, refunds, and customer inquiries promptly if fulfilled by Creator

8.2 Commission and Payments
Sellers agree to pay commission and fees as defined in the separate Seller Agreement. Settlement of product sale proceeds will be subject to verification, deductions, and applicable taxes.
8.3 Prohibited Items
Sellers must not list products that are illegal, unsafe, infringing, or prohibited as per Indian Laws. We may remove such listings without notice.
9. Coupons, Discounts, and Promotions #
9.1 Coupon Use
Coupons, discount codes, or promotional offers (“Coupons”) made available on the Platform are subject to:
- Specific terms, including minimum purchase value
- Validity period
- One-time use or limited use as specified
Coupons cannot be exchanged for cash and cannot be combined with other offers, unless expressly permitted.
9.2 Misuse
We reserve the right to cancel or void Coupons in case of misuse, fraud, or violation of these Terms.
10. Newsletters and Marketing Communications #
By creating an account, you consent to receive marketing emails, SMS, or messages regarding offers, products, and updates.
You may opt out at any time by using the unsubscribe mechanism in the communication or by contacting us.
11. Third-Party Integrations #
Our Platform may include integrations with third-party services for:
- Payments
- Logistics and delivery
- Analytics and tracking
- Marketing automation
- Social media features
Your use of these integrated services is subject to the respective third-party terms and privacy policies. We are not responsible for any data handling practices or disputes arising from those services.
12. Intellectual Property #
All content on the Platform, including trademarks, logos, designs, text, graphics, and software, is owned or licensed by us. You agree not to copy, reproduce, or use any content without written permission.
13. Limitation of Liability #
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Platform, even if advised of the possibility of such damages.
Our total liability for claims related to the Platform shall not exceed the amount paid by you for products purchased in the three (3) months preceding the claim.
14. Indemnification #
You agree to indemnify, defend, and hold us harmless from any claims, losses, liabilities, damages, costs, and expenses arising from:
- Your breach of these Terms
- Misuse of the Platform
- Violation of applicable laws
- Claims by third parties
15. Termination #
We may suspend or terminate your access to the Platform at our discretion, without notice, for conduct that violates these Terms or is harmful to other Users, us, or third parties.
16. Governing Law and Jurisdiction #
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Goa, India.
17. Amendments #
We reserve the right to modify or update these Terms at any time. Updated versions will be posted on the Platform with a revised “Last Updated” date. Continued use after changes constitutes acceptance.
